OREGON ENACTS STATUTE REGULATING AUTOMATIC DIALING AND ANNOUNCING DEVICES

Oregon recently enacted a new statute regulating automatic dialing and announcing devices ("ADADs"). See 2007 Or. S.B. 863 (effective Jan. 1, 2008). The new statute applies to calls made to telephone subscribers by means of an ADAD on or after January 1, 2008. The new statute:

  • Requires a caller to disconnect an ADAD within 10 seconds after the subscriber terminates the call;
  • Prohibits a caller from using an ADAD to dial certain telephone numbers randomly or sequentially;
  • Permits a caller to use an ADAD only between the hours of 9 a.m. and 9 p.m.
  • Prohibits a caller who uses an ADAD to misrepresent or falsify certain information, such as the caller's identity and the purpose of the call; and
  • Prohibits a caller from interfering with a subscriber's caller identification services.
